I read with great interest your comparison of the brands Polo and Ralph Lauren. What is presented in your article has elements that are true and some that are incomplete in either in chronology or fact. For example, Polo and Ralph Lauren, as brands, originally were designations for men’s products (Polo) and women’s products (Ralph Lauren) under the leadership of Ralph Lauren, the designer, in 1968. As more product categories came on board, the Ralph Lauren brand was generally applied; for example, Ralph Laren Home for home furnishings.

At a much later time, two other separate companies, Beverly Hills Polo Club and U.S. Polo Association launched apparel lines under those respective names. Use of the the word “Polo” was challenged in litigation between the entities. Agreements for the various entities were reached, but only the company operated by Ralph Lauren, the man, could use the single name “Polo” as a brand name, for example: Polo cologne.

Nice information especially since when I think about Polo it is Ralph Lauren that I associate into my mind rather than the other two.

If you’re going to make an article like this, get your facts straight: US polo assn was made in 1890 before Ralph Lauren. A quick Google search will show you the year it was founded. It’s not hard.

Polo Ralph Lauren v. U.S. POLO ASSN. – A 38-year Trademark Saga

Introduction

In class a few weeks back we compared the two penguin designs that were the subjects of the case, Promafil Canada Ltée v. Munsingwear Inc . This case got me thinking of two logos that have caused me some confusion personally. Polo Ralph Lauren (PRL) and the US Polo Association (USPA) both use a logo that to me is remarkably similar. When I first came across USPA goods while shopping in Winners, I remember assuming that they were goods from PRL. I was familiar with Ralph Lauren but had never heard of the USPA brand before. Upon further inspection, I noticed there were two horsemen in the USPA logo as opposed to the single horseman logo I was familiar with in regards to PRL clothing. I further assumed this was some offshoot of their PRL brands like Polo Ralph Lauren Red or Double RL. It was not till years later that I actually realized this was a completely different brand. I had purchased plenty of sets of boxers thinking they were associated with PRL. Now, I am not upset with my purchase, USPA makes perfectly adequate garments too, but I was definitely persuaded to purchase their garments thinking they were coming from PRL. I brought up this example in class when we were discussing the doctrine of confusion and Professor Festinger invited me to look into it to explore what’s been going on with these two companies.  

An Embattled History

Turns out PRL and USPA have been dueling in the courts regarding this issue for decades. The dispute started back in the 1980s. Ralph Lauren was founded in 1967 and began producing its iconic PRL fragrance in 1978. Enter the US Polo Association. Despite having existed since 1890 USPA never engaged in product creation or licensing until the late 1970s when PRL began gaining popularity (red flag). USPA began producing goods and specifically a fragrance that bore the word “POLO” and a logo with 2 horsemen that was quite similar to PRL’s iconic single horseman logo. In 1984 USPA launched an action against PRL seeking a declaratory judgment that various articles of merchandise bearing a mounted polo player symbol did not infringe PRL’s Polo player logo. PRL filed a countersuit for trademark infringement alleging the use of the double horsemen logo (designed in 1981) infringed on their logo. USPA tried to argue that the logo was a weak mark and just a realistic depiction of a polo player and had not acquired any secondary meaning. The court’s response to this line of argument was if USPA thought the mark to have no secondary meaning – why were they trying so hard to copy it? The judge in the 1984 case found that USPA had been infringing on PRL’s marks, specifically their polo player mark and the word “POLO.” USPA and their licensees were enjoined from using their marks that infringed on PRL’s marks. The court however allowed USPA to continue its retail licensing program and left open the possibility of USPA using its name, and a mounted polo player that was distinctive from PRL’s polo player in its content and perspective. This left USPA able to produce various retail items. 

The battle did not stop there. Once again in 2000, PRL entered litigation against USPA seeking to bar the use of the USPA name, the double horsemen mark, and multiple variants. It seemed like the two companies were finally finding some common ground by entering a partial settlement in 2003 allowing USPA to use its name and certain other logos on apparel, leather goods, and watches as well as incorporating the 1984 order giving PRL a mechanism to raise complaints and objections when it felt USPA were violating their rights or the settlement. Despite this seeming progress, the parties remained unsettled on the matter of four variants of the double horsemen logo and took to court. In 2005, a jury found that three out of the four logos in question (an outline of the double horsemen, solid double horsemen with ‘USPA’, and an outline of double horsemen with ‘USPA’) did not infringe PRL’s marks but the solid double horsemen logo did. PRL tried to appeal in 2006 but this request was denied. This bout led to USPA being allowed to use their marks on apparel, watches, and leather goods. 

These two combatants weren’t done just yet. USPA filed a suit seeking a declaratory judgment to let them use the words “U.S. POLO ASSN.,” the double horsemen logo, and “1890” to sell fragrance products – the creme de la creme of PRL’s product line. Of course, PRL countersued. The court in 2011 determined that USPA’s “confusingly similar” logo with two mounted polo players and their use of the word “POLO” infringed on PRL’s marks with respect to fragrance products. The court noted that, unlike apparel, PRL’s Player logo and POLO trademarks for fragrance products were valid and “extremely strong” and thus were entitled to be afforded substantial protection from infringement. PRL’s original scent had actually been inducted into the Fragrance Foundation hall of fame in 2004. The court took this further and claimed that USPA had acted in bad faith by producing a fragrance with the double horsemen logo and the word “POLO”  knowing the product had a high likelihood of causing confusion. This led to USPA being enjoined from using the marks in relation to any fragrance product. PRL was also granted a permanent injunction imposing a duty on USPA to use a distinctively different mark from PRL’s polo horsemen logo on “any goods or rendering of any services” aside from those found to be non-infringing in the apparel litigation.

2012-Present

But wait, there’s more. USPA put the above injunction to the test entering the eyewear market with their double horse logo and the word “POLO.” PRL unsurprisingly took USPA to court once again. PRL had been making eyewear since the late 70s and citing the previous injunction, the court came down on USPA and held that USPA was in contempt for violating the injunction awarding PRL any profits coming from the sale of USPA eyewear bearing the double horsemen logo. In 2015 on appeal, the higher court vacated the contempt order and sent the case back down to the lower courts for further review explaining that the current record could not support a finding for contempt. In 2016, USPA filed for summary judgment for a finding they were not in contempt of court, PRL requested the motion be denied in favour of a targeted discovery process. The motion for summary judgment was denied and the now 38-year saga of litigation continues to the present day.

Polo v. polo – ralph lauren and the u.s. polo association, january 11, 2012.

This topic came up during a recent stroll through the mall with my fiancee. We noticed a store billing itself as U.S. Polo Assn. Their products appeared to be preppy-style casual clothing for men and women, with a prominent logo featuring two polo players on horseback. Where have I seen something like this before?

It turns out the U.S. Polo Assn. isn’t related to Ralph Lauren at all. Instead, this brand is the licensing arm of the actual U.S. Polo Association, dating back to 1890. Yes, kids, before Polo was a brand, polo was a sport. I won’t link to their site, uspolo.org, because it currently opens up a promo video with annoying music. Web designers, please don’t have your website play any sound unless the viewer actively clicks something to make it happen – I thought the entire Internet community agreed on that rule back in about 1997. But I digress…

So, it seems that about 30 years ago, the USPA, as I like to call it, decided to start offering branded goods for sale. Ralph Lauren’s Polo brand had launched back in 1967. In 1984, a Federal court held that the USPA could produce licensed goods as long as they were not branded in such a way that they would be likely to cause confusion with Ralph Lauren’s famous Polo brand. As my regular reader will know, likelihood of confusion is the chief issue in most trademark questions.

It seems that the USPA has, in recent years, expanded its branding and licensing in ways that have brought it closer to conflict with the RL brands. One such issue came to a head a few years ago, when the USPA began producing U.S. Polo Assn. branded perfume. Among many other products, Ralph Lauren is well-known for its line of Polo perfumes. RL brought suit, and the same Federal court ruled in 2011 that the USPA’s product infringed on Ralph Lauren’s trademarks .

Currently, the U.S. Polo Assn. website doesn’t feature any perfume products. It’s unclear whether they will try to repackage the products in such a way as to attempt to avoid infringing on Ralph Lauren’s marks, or whether they will abandon the perfume market altogether.

Considering the larger questions for a moment – shouldn’t the U.S. Polo Association be able to use the word “Polo” and related terms and images on products? A fashion designer picked that word for his products, and designed a logo featuring a polo player. Does that mean that the USPA should have lost some group of rights that it presumably held? Can I go out and start a fashion line under the brand name David Lizerbram Baseball, and then turn around and prevent Major League Baseball from exploiting the name and imagery of their sport?

As to the latter question, the answer is certainly “No.” MLB already produces and licenses a huge array of consumer products. Back when Ralph first picked the sport of polo as his sartorial inspiration, the USPA seems not to have been engaged in product creation or licensing at all. They were, you know, a bunch of people riding horses and hitting balls with mallets (that is the sum of everything I know about the sport of polo, so don’t ask me anything else).

For the most part, RL’s products have little or no connection to the sport itself. Polo aftershave has as much to do with the sport of polo as an apple (meaning, the fruit) has with Apple Computers. RL expended vast quantities of time and money convincing consumers that the word “Polo” connoted a desirable product and lifestyle brand.

Furthermore, RL didn’t compete with the USPA in their core business – he didn’t try to set up a polo association. He took an existing word and used it as a brand in innovative ways. That’s exactly what a large proportion of trademark owners do (the exception being those who create new words entirely).

Back when RL was getting started, the USPA could have acted more swiftly to stake their claim in the word “polo.” Instead, they waited for about 15 years to begin exploiting their brand name. It looks like they’re now trying to make up for lost time, and it will be interesting to see if this will lead to future conflicts between the two brands. For now, just remember: one polo player equals Ralph Lauren; two polo players equals the U.S. Polo Association, and three polo players means the product is probably a knockoff of both brands at once.

The name Ralph Lauren is synonymous with preppy, classic style and a country-club appearance. He is one of the most famous designers in the world, working to create a line that’s casual and upscale. He took a classic polo shirt, added a horse and stuck a $60 price tag on it so many years ago and managed to create a brand that’s become one of the most iconic in the world. Ralph Lauren is a true legend in the fashion industry, and he’s not going anywhere anytime soon. Here are 20 things you did not know about the famed designer.

He Did Not Invent the Polo

When Ralph Lauren was born in 1939, he was named Ralph Rueben Lifschitz. He was born in the South Bronx, and most people don’t even realize that Ralph Lauren is not his name or that he was even born in New York. Many people think he was born elsewhere, but he was not born into a wealthy family. What most people don’t know is that he wasn’t born Ralph Lauren, and when they find out they assume he changed his name on his own, but that’s not true either.

He was Not Born Ralph Lauren

What’s strange about the fact that Ralph’s last name was changed to Lauren is the fact that he is not the one responsible for changing their name when he decided to become a designer. When he was 16, his brother Jerry decided that the family needed to change their last name and did so to Lauren. Their other brother Lenny decided he was not going to change his name for many years. He retained the last name Lifschitz for many years before deciding to change it to match his brothers.

His Brother Changed Their Name

Back in 1999, Ralph Lauren shut down the production of an entire magazine because the magazine called itself Polo. The magazine was a subsidiary of the U.S. Polo Association and it was something that Lauren did not think was appropriate. He filed suit against the company and the magazine and the court shut it down. However, it 2001 the ruling was reversed and the magazine was allowed to continue production. However, they did have to include a disclaimer in every issue that states they are in no way affiliated with Polo Ralph Lauren.

He’s Powerful

The New York-native decided to launch a line of women’s wear in California in 1971. He made the decision to classify women’s clothing in four categories; classic, country, active and collection. They each had the signature tailoring that made the clothes fit just right and they each had a feminine twist that made them appealing to women everywhere. The line was vastly successful, and he remains one of the most famous designers for both men and women in the world.

He Launched His Woman’s Line in California

It’s not often you hear about the most famous designers in the world serving in the army, but Lauren did. He was a U.S. Army Reservist for two years following his college education. He even used his time in the military as influence for his collections when he decided to become a designer. He remembers that his uniformed officers were very impressive and he used that memory to help him create a line of strong menswear that inspires confidence and power. It’s something that’s served him well over the course of his long and successful career in the fashion industry.

He’s an Army Vet

In 1999, Ralph Lauren decided his corporation would purchase another famous designer line called Club Monaco. He did just that for a purchase price of $52.5 million. He’s since turned the famous brand into one that’s even more famous and popular than ever before. The hugely successful line is known for its preppy pieces and its upscale appeal. It’s sold all over the world, and it’s a line that people love when it comes to finding casual wear for the weekend, vacation and for the golf course.

He Owns Club Monaco

If you’ve been in a Ralph Lauren section at any major department store lately, you know that there is what feels like a million colors in his polo collection. When he introduced the polo in 1972, he offered it in 24 colors. If you are a man with a love of Ralph Lauren, you have his polos in all of those colors, plus the additional colors that have become popular over the past several decades. It’s impossible not to find a polo in just about every color and every shade of every color imaginable. It’s hard to believe there were only 24 colors available initially.

The Polo Came in 24 Colors

He’s got a car collection that will make any car lover green with envy. Lauren’s collection includes some of the most prolific designs of all time, including a few one-of-a-kind vehicles you will not find in any other collection. He has a 1938 Bugatti 57 S(C) Atlantic that was built by hand by the maker of the brand. There are only four of them in the world, and Lauren has one in his hugely extensive and impressive collection of vehicles. It’s one that rivals anyone’s in the world in terms of luxury and size.

If there is another line that’s just as preppy and classic as his own, it’s Brooks Brothers. Lauren got his start in the fashion industry as a salesperson at the Brooks Brothers on Madison Avenue. He was 24 when he got the job. His time at the store gave him some experience in fashion so that he could learn what was stylish, what people wanted and how to dress a man to his own standards. The experience was vital to the successful nature of his career as a designer.

He Worked for Brooks Brothers

When the line of polos launched in 1972, the designer almost had to declare bankruptcy. He’d taken on a $50,000 loan from Norman Hilton a few months before, he’d invested nearly $100,000 of his own money into the line and he was the 90 percent owner of the company while a man by the name of Peter Strom was a 10 percent owner. The line was successful, but no one was managing the finances of the company very well and it wasn’t a good outlook. Fortunately, Lauren was able to hold onto this line and fix his financial situation.

The Brand Almost Went Bankrupt

The name RRL comes from the Double RL Ranch in Telluride, Colorado, which is where the Lauren’s have a home of their own. Lauren’s wife’s name is Ricky, and that’s where the RRL comes from. The line with this name was inspired by the type of clothing that Ralph Lauren likes to wear when he’s on his ranch in Colorado, and that’s why it’s an earthy, preppy, a bit more down-to-earth collection than the things he normally has is in his everyday collection. It’s a great line with great inspiration.

The RRL Collection is Special

This is something most people just don’t know. Ralph Lauren and his wife have a daughter named Dylan, and she was inspired by Willy Wonka’s chocolate factory so much so that she created her own line of candy shops. Her shop was first opened in New York City in 2001 and she’s been successful enough to open several more locations across the country since she went public more than a decade ago. She cultivated her love of candy and art when she was at Duke University and has been successful in her work ever since.

Not only did Ralph Lauren begin designing by making ties out of old rags, he would sell them on his own. He first began going door-to-door at stores and shops in New York City to try and sell his ties, and he eventually sold them right out of his bag at the base of the Empire State Building. Believe it or not, his ties were a huge hit. He made them wider and more stately than other ties that were popular at the time, and men loved them. It was his first success in the fashion industry.

He Sold his Own Ties

When he was 29-years-old, he was given a $50,000 loan from a man by the name of Normal Hilton, who was a firm believer that Lauren would make a wonderful designer. He gave Lauren the money to start his own collection and start his brand. It was a sound investment, as Lauren would go onto become one of the most successful designers in the world. He even bought the name Polo from Hilton, and it’s become his own sort of iconic introduction to the fashion industry over the years.

He Received His First Investment in 1968

When you are one of the greatest fashion designers of all time, you are certainly going to see a lot of famous designers come into your employ at sometime. Most all designers have to get their start somewhere, and many have done so with Ralph Lauren. For example, Simon Spurr, Frank Muytjens, and Michael Bastian have all worked for Ralph Lauren. He even employed Thom Browne, who was at one time a create director for Club Monaco, another very preppy line of clothing that inspires both men and women.

He’s Employed Great Designers

When Lauren was just getting started in the business, he talked to someone at Bloomingdales who asked him to do some very strange things. They asked the designer to take his name off the label of his ties and replace them with their own label, which was Sutton Place. They also wanted the designer to remake the ties so that they would be a quarter inch slimmer. When Lauren declined on both accounts, Bloomingdales would not sell his ties. They called him six months later and bought a ton of his ties to sell – Lauren’s way – in their stores.

Bloomingdales Made Strange Requests

When True Grit was filmed in 1969, part of the home that Ralph Lauren lives in with his wife in Telluride, was used in the film in many different scenes. The Double RL Ranch was named after Lauren and his wife of more than 46 years. The film was shot here long before Lauren owned the home, but it still goes down in history as one of the coolest houses in the world. It would have to go down in history for this considering one of the most famous John Wayne movies of all time was filmed here.

His Home Is Famous

Ralph Lauren is not a polo player, yet he chose this to be the name of his massive brand. He once told Oprah Winfrey that he loves sports and wanted the line to have an athletic appeal, but that he certainly couldn’t call the line “Basketball Ralph Lauren,” so he chose the must more appropriate “Polo Ralph Lauren,” and went from there. He feels that it’s an international sport that’s a bit sophisticated and loved by many, so he picked it to be the name of his famous company.

Why He Chose the Name Polo

Ralph Lauren did not always want to become a fashion designer. In fact, his first and most prominent career choice was vastly different from the career that’s made him famous. He wanted to be Batman. If Lauren could have found a way to become Batman in real life, he would have. He’s a huge fan. However, when he was old enough to realize that Batman was not one of the most intelligent career choices for someone who wanted an income, he decided a fashion designer would do. Good choice.

None of these answers are wrong. In fact, all of them are spot-on for one of the many archetypes—preppy, hip-hop, athlete, aristocrat—that Lauren has conjured in the 56 years since he launched Polo . More recently someone not usually associated with the Canon of Ralph has popped up wearing those signature ponies all over town: the creative cool kid.

Usually found downtown, whether that means Ridgewood, Queens, or Silver Lake in L.A., these characters wear Polo in a kind of post-ironic way, finding the once ubiquitous rugby shirts, windbreakers, and American flag and Polo Bear sweaters on vintage or resale sites and folding them into their everyday wardrobes.

On a recent morning Haley Wollens, a stylist best known for her frequent collaborations with Chloë Sevigny, wore a Polo rugby on her morning coffee run on New York’s Lower East Side (not far from where this story was photographed, at the Nine Orchard hotel). “My style is pretty wacko, but sometimes I feel like I look best when I’m just preppy,” she says. Except she’s not just preppy. She and her cohort prefer their Polo a little rumpled, a little subverted. In 2022 Wollens, the designer Lou Dallas, and the graffiti writer Claudia Gold (tag: Claw Money) took a bunch of old Polo rugby shirts, cut them up, and printed all over them to create a small capsule.

“People went crazy for them,” Wollens says. Chris Peters, the designer behind CDLM , a fashion line made from upcycled vintage, and a consultant for the cult label Puppets and Puppets, got into vintage Polo during the pandemic, when he was staying with his parents in his childhood home in New Jersey. Most of his clothes were back in Manhattan, so he dipped into his brother’s Polo trove from high school. It felt right. He likes the contrast between the tailoring of the clothes and his own aesthetic.

“I wouldn’t say I’m grubby, but I wear kind of fucked-up stuff,” he says, adding that he and his partner, the ceramicist Shane Gabier, seek out ’90s Polo, preferably artfully stained or sun-bleached, on eBay. “We’re deep in it,” Peters says. “We have a running list of Polos and buy one or two every other week.”

It’s not just arty types seeking semi­destroyed garments with whom Polo is resonating. Beverly Nguyen, proprietor of her namesake homewares shop, now mixes in Polo with the polished, often sexy look she favors. The American flag sweater she originally owned as a five-year-old? She got a new one last summer.

“I’ve never seen Polo not being worn,” Nguyen says, although she has noticed a recent uptick that she credits to fondness for an aesthetic embodied by Carolyn Bessette Kennedy , old school Gap and J.Crew catalogs, and, of course, Polo. Then there’s The Crown recalling Princess Diana’s affection for Polo button-downs and collegiate sweatshirts over bike shorts. “It’s that longing for all-American sportswear. There aren’t a lot of American heritage brands that exist anymore.”

Polo, launched originally in 1967 as a collection of neckties inspired by Old Hollywood, has long since reached the point of universality. Within five years Lauren had opened his first store on Rodeo Drive and introduced the Polo pony and the iconic cotton mesh Polo shirt in a rainbow of colors. It was just the beginning. With its many subsets and licensing deals over the years, there’s something for everyone to buy into.

“One thing that helps Polo always retain some baseline of relevance is that there are so many different directions that Ralph Lauren went in,” says Jonah Weiner, co-­author of the menswear newsletter Blackbird Spyplane . Weiner found himself down a vintage Polo rabbit hole last year, chasing a color­block jacket from the Polo Country line, informally known as the Red Line, via an Insta­gram reseller.

“There’s the western end of the spectrum occupied by Polo Country and RRL. There’s the more classically tailored energy of Ralph Lauren Purple Label and the main line. There’s the distinctly American , collegiate register of the slouchy, ’80s/’90s prep, defined by loose, pleated pants, frayed collars, and stretched-out mismatched socks. We see that at a lot of new brands that are extremely expensive,” Weiner says. As for the rugby shirt, it’s been embraced over the years by everyone from hip-hop artists to ravers. “That gives them an unending life—it’s like how the sun is always shining somewhere.”

For a large swath of the population, Polo has transcended fashion to become the fabric of people’s lives, no matter where they come from. “The working classes in the UK always latched onto certain designer names as a way of elevating themselves,” says London-based hair stylist Halley Brisker, whose clients include actors Lily James, Julianne Moore, and Eve Hewson. “For a long time when I was growing up, Ralph was a real emblem of a certain type of working class person who would wear it on the weekend to go to the pub, because they were like, ‘Yeah, this is nice gear.’ ”

In his teens and twenties Brisker was one of them, but as the Polo-wearing tide shifted toward Jersey Shore types (“chavs,” in British parlance), he says, “I went off it.” Then one day nearly 20 years later, he bought a pink rugby shirt emblazoned with the word Polo across the chest and a matching bucket hat that looked like something he owned during his Polo 1.0 phase.

“As with everything in fashion,” Brisker says, “when things become uncool enough, they become cool again.”
